Copyrights and Terms of Service
1.1. All drawings may include a subtle sign (or signature) that you may not remove.
1.2. I reserve the right to post the artwork on my social media accounts (Instagram), my portfolio, and art books.*
1.3. I might record the drawing process and post it on my YouTube Channel.*
1.4. Prices are subject to change based on demand.
1.5. I have the right to reject any order that I do not feel comfortable drawing for any reason.
*(unless client requests artwork to remain private at initial consultation which would call upon a buyout charge of 50%. Photos used of the client can be requested to be kept private at no extra charge)
2. PAYMENT
2.1. Currency accepted is INR for Indian Bank Accounts/Customers and USD for International Postal addresses which can be paid through PayPal only.
2.2 Commissions are paid 100% upfront unless the order value exceeds INR 50k.
2.3 Don't send me any payment before I have agreed to save you a slot and requested that the payment be sent after Invoicing.
3. PROCESS & DELIVERY
3.1. I will notify you when the commission will be started, at which point refunds will no longer be allowed (see point 6 further below for more info on refunds).
3.2. The time it takes to finish your commission varies 2 - 6 weeks depending on factors such as health, the complexity of the commissioned piece, and other work.
3.3. If anything comes up that will slow the progress of the initially estimated delivery time I will let you know as soon as possible.
3.4. Once the piece is finished you will receive the full-resolution (approximately 2400 x 3200 px 300 dpi) image in PNG format. The format will be discussed with you before work commences.
4. REVISIONS
4.1. 2 rounds of changes on the commissioned piece are included in the price. Major changes can be done at the draft stage and the sketch stage. Only minor tweaks and color changes can be done after the artwork is completed.
4.2. A fee will be added if you want something changed on the final artwork - unless a misunderstanding from my side has been made.
4.3. If you wish for me to change something in the drawing you have previously approved, I will charge you a fee to change it. The amount of the extra charge depends on the change you want me to make and is usually based on an hourly wage.
4.4. Any extra charges invoiced must be paid must be paid BEFORE the work is delivered.
5. COPYRIGHT & USAGE
5.1. I, SketchedUp20/Rahul Patil (the artist):
5.1.1. Reserve the right to cancel and refund the order at any time for any reason.
5.1.2. Retain all copyrights over the commissioned artwork.
5.1.3. Will NOT claim the intellectual property (IP) of the commissioned artwork.
5.1.4. Will NOT profit further from the commissioned artwork unless you (the customer) break any of the terms.
5.1.5. Reserve the right to post the commissioned artwork online, in my portfolio as well as in publications such as art books.
5.2. You (the client):
5.2.1. May upload the commissioned artwork on any website and social channels or make non-profit Prints of it.
5.2.2. May NOT make profits from the commissioned piece (reselling, redistributing, make prints, etc.).
5.2.3. May NOT alter the commissioned artwork without my (the artist's) consent.
5.2.4. Retain the rights to the intellectual property (IP).
5.2.5. May NOT use the commissioned artwork for commercial purposes.
5.2.6. May in some cases, request to purchase the commercial rights to the image, at the artist’s discretion.
5.3. The following is considered copyright infringement:
5.3.1. Reproducing/using the copyrighted artwork commercially.
5.3.2. Claiming the artwork as your own.
5.3.3. Altering the artwork without my consent.
6. CANCELLATION & REFUND POLICY
6.1. I will do everything I can to make my customers happy!
6.2. If you have a problem with anything in regards to the commissioned piece please tell me right away so we can find a solution together.
6.3. I am willing to change some of my terms for you if you ask before I start on your commission. If you, e.g., do not want me to post your art anywhere, we can discuss this.
6.4. The buyer is not allowed a refund once I started working on the commission.
6.5. If for any reason I am unable to start your commission you will receive a full refund.
6.6. If you cancel your order before I start work on it, you can get a full refund.
IF THE BUYER BREAKS ANY OF THE POINTS STATED ABOVE THEY WILL LOSE ALL THE BEFOREMENTIONED RIGHTS TO THE ARTWORK COMMISSIONED BY ME, SKETCHEDUP20/RAHUL PATIL (THE ARTIST), AND I WILL HAVE THE RIGHT TO PROFIT FURTHER FROM THE COMMISSIONED ARTWORK IN ANY WAY I SEE FIT.
IF YOU HAVE A PROBLEM WITH ANY OF THESE STATEMENTS, THEY MAY BE CHANGED IF DISCUSSED WITH ME PRIOR TO PAYING FOR YOUR COMMISSIONED PIECE.
WHEN COMMISSIONING ME, THE ARTIST, YOU HAVE AGREED TO THESE TERMS AND CONDITIONS WILLINGLY.
